When a child is born to married parents, the Husband is automatically presumed to be the biological father. When a child is born to unmarried parents, the Mother is the natural guardian and the Father has no legal rights. The Father has no legal rights or responsibilities of a parent until paternity is established through a Court Order.

Mothers often file paternity actions to obtain child support or to ensure that the father follows an appropriate time-sharing schedule.  Fathers often file paternity suits because the Mother is denying visitation or they would like to solidify their relationship with their child.
